By accessing or using Kascade's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Description of Services
Kascade provides custom website design, development, hosting, and related services on a subscription basis. Our services include:
- Custom website design and development
- Professional copywriting
- Search engine optimization (SEO)
- Website hosting and SSL certificates
- Content management system (CMS) access
- Ongoing maintenance and updates as described in your plan
3. Subscriptions and Billing
Our services are billed on a monthly subscription basis. By subscribing, you agree to:
- Pay the monthly fee associated with your selected plan
- Provide accurate and complete billing information
- Authorize us to charge your payment method on a recurring basis
Prices may change with 30 days' written notice. You may cancel your subscription at any time, effective at the end of your current billing period.
4. Delivery and Revisions
We aim to deliver your initial website within 24 hours of receiving your completed brief. Delivery timelines are estimates and may vary based on project complexity. Each plan includes a specified number of revision rounds as described on our pricing page.
5. Your Responsibilities
You agree to:
- Provide accurate business information and content for your website
- Ensure you have the right to use any materials (logos, images, text) you provide to us
- Not use our services for any unlawful purpose
- Not upload or transmit harmful code, malware, or content that violates any law
- Maintain the confidentiality of your account credentials
6. Intellectual Property
Your Content: You retain ownership of all content, images, logos, and materials you provide to us. By submitting content, you grant us a license to use it solely for the purpose of delivering our services.
Our Work: The website design, code, and structure created by Kascade remain our intellectual property while your subscription is active. Upon cancellation, we will provide an export of your site content upon request.
Third-Party Assets: Some elements (fonts, stock images, icons) may be subject to third-party licenses. We ensure all assets used are properly licensed for your use.
7. Hosting and Uptime
We provide hosting as part of your subscription. While we aim for 99.9% uptime, we do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by factors beyond our control.
8. Cancellation and Refunds
- 7-Day Guarantee: If you are not satisfied with your website within the first 7 days of delivery, we will issue a full refund.
- Monthly Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle.
- Data Export: Upon cancellation, we can export your website content and files upon request within 30 days.
9. Limitation of Liability
To the maximum extent permitted by law, Kascade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services.
Our total liability for any claim related to our services shall not exceed the total fees you paid to us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Kascade harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your content, or your violation of these terms.
11. Modifications to Terms
We may update these terms from time to time. Material changes will be communicated via email or by posting a notice on our website. Continued use of our services after changes constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
